Abstract

Contrairement à ce qui existe en matière d'échange, le système multilatéral est dépourvu d'un cadre global pour l'investissement. C'est pour remédier à cette absence que se sont ouvertes en mai 1995, dans le cadre de l'OCDE, les négociations pour la conclusion d'un Accord multilatéral sur l'investissement (AMI). Toutefois, fin octobre 1998, les négociations sont définitivement suspendues.

À aucun moment depuis la fin de la Seconde guerre mondiale, la perspective d'une poursuite de la libéralisation n'a suscité autant d'inquiétude dans l'opinion publique, y compris dans les pays mêmes qui ont largement bâti leur prospérité sur les politiques libérales en matières d'investissement. Pourquoi une telle inquiétude face à l'AMI?

L'objet de la présente étude est d'analyser le régime juridique mis en place par l'AMI en matière de libéralisation afin de déterminer si l'opposition soulevée par cet accord se justifie eu égard à son contenu.

Unlike what exists in terms of trade, the multilateral system lacks a global framework for investment. It was to remedy this absence that negotiations began in May 1995, within the framework of the OECD, for the conclusion of a Multilateral Agreement on Investment (MAI). However, at the end of October 1998, negotiations were definitively suspended.

At no time since the end of the Second World War has the prospect of further liberalization aroused so much public concern, including in the very countries that have largely built their prosperity on policies liberal in investment matters. Why such concern about the AMI?

The purpose of this study is to analyze the legal regime put in place by the MAI in terms of liberalization in order to determine whether the opposition raised by this agreement is justified in view of its content.
